A will contest is a type of litigation that challenges the validity of a will or portion thereof on the basis of one of the following: that the will had been revoked, that the decedent lacked the mental ability to write the will, that the will was not properly completed, that the decedent was unfairly influenced and coerced, that the will was completed as a result of fraud, or that the will was mistakenly completed. The court, at the conclusion of litigation, will determine whether the will is valid. The court may deem a portion of the will invalid while validating the remainder under certain circumstances.
